Article 1 — General Scope

These Terms and Conditions ("T&C") govern your use of the Pledge Central platform, including the website at https://pledgecentral.goodbarber.app, the Pledge Central mobile application, and any SMS text messaging communications associated with the Central Florida Pledge campaign operated by the Ginsburg Family Foundation ("Foundation," "we," "us," or "our").

By using our platform or services — including texting a keyword to participate in the Central Florida Pledge — you agree to these T&C without reservation. If you do not agree, please do not use our services.

We reserve the right to update these T&C at any time. Updated terms are effective upon publication. Continued use of our services constitutes acceptance of any changes.

You must be at least 18 years of age, or have consent from a legal guardian, to use our services.

You agree not to use our services for any illegal or unauthorized purpose, and not to attempt to compromise the security, integrity, or functionality of our platform.

Article 2 — SMS Text Messaging and Mobile Communications

Consent and Opt-In

By texting the keyword PLEDGE to our designated number, you expressly consent to receive automated text messages from the Ginsburg Family Foundation related to the Central Florida Pledge program. This includes confirmation messages, community updates, and program-related communications.

Your consent to receive SMS messages is not required as a condition of any purchase or participation in any program.

Message Frequency

Message frequency varies. You may receive up to 3 messages per opt-in interaction. Additional messages may be sent for community updates or campaign activities.

Message and Data Rates

Standard message and data rates may apply depending on your mobile carrier and plan. The Foundation is not responsible for any charges incurred through your mobile carrier.

How to Opt Out

You may opt out of SMS communications at any time by replying STOP to any message you receive from us. Upon receipt of your STOP request, we will send one final confirmation message and no further messages will be sent to your number.

Data Use

Your mobile number and any information collected through SMS interactions is stored securely in our CRM system and used solely for pledge tracking and community communications. We do not sell, rent, or share your mobile number or personal information with third parties for marketing purposes.

Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to network availability and carrier policies.

Article 3 — Content and Intellectual Property

All content available through our services — including text, images, logos, visual identity, and application design — is the property of the Ginsburg Family Foundation and is protected by applicable copyright and intellectual property laws.

You may not reproduce, copy, modify, sell, transmit, or distribute any content from our services without prior written permission. This includes our name, logo, and visual identity.

Content provided through our services is intended for personal, non-commercial use only.

Article 4 — User Accounts and Registration

If you choose to create an account on our platform, you are responsible for maintaining the confidentiality of your credentials. Each account is for individual use only. Do not share your login information with others.

Notify us immediately at info@ginsburgfamilyfoundation.org if you believe your account has been compromised.

We reserve the right to suspend or terminate accounts that violate these T&C without prior notice or compensation.

If you choose to sign in using a third-party authentication service (such as Google or Apple), your relationship with that provider is governed by their own terms and privacy policies, which we encourage you to review.

Article 5 — User Conduct and Content

If you submit, post, or upload any content to our platform, you represent that you have the legal right to do so.

You agree not to:

• Post content that is abusive, threatening, obscene, discriminatory, or illegal
• Impersonate any person or organization
• Transmit malware, viruses, or any harmful code
• Use hate speech or harass other users based on race, religion, nationality, gender, sexual orientation, age, disability, or any other characteristic
• Spam or flood our communications channels

We reserve the right to remove content or suspend accounts that violate these standards, without prior notice or compensation.

Article 6 — Warranties and Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind. We do not guarantee that our content is error-free, complete, or current, or that our services will be uninterrupted or secure.

You use our services at your own risk. We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.

Article 7 — Limitation of Liability

To the fullest extent permitted by law, the Ginsburg Family Foundation, its staff, employees, volunteers, and agents shall not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of our services. This includes but is not limited to loss of data, network disruptions, or unauthorized access.

Article 8 — Third-Party Links

Our platform may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of any third-party site. Accessing third-party links is at your own risk, and we encourage you to review their terms and privacy policies.

Article 9 — Indemnification

You agree to indemnify and hold harmless the Ginsburg Family Foundation and its representatives from any claims, damages, or expenses — including reasonable attorney's fees — arising from your breach of these T&C or your use of our services.

Article 10 — Severability

If any provision of these T&C is found to be unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Article 11 — Termination

These T&C remain in effect until terminated. You may stop using our services at any time. We may terminate or suspend your access at our sole discretion, without prior notice, if you violate these T&C.

Article 12 — Governing Law and Venue

These Terms and Conditions are governed by the laws of the State of Florida. Any disputes arising from these T&C shall be resolved in the courts of Orange County, Florida.
